I took the below steps:
- I wrote to the collector a Cease and desist letter. Upon
receiving such a letter the collector must stop immediately his collection efforts. I have attached a letter in word format to the NCO company as my own example. Please note that the second page of the letter incorporate a proof of service.
- After writing the letter I log all the NCO collector
phone calls to me. Meaning I wrote down the date, the time, the name of the collector company, the name of person that made the call, and the nature of the conversation, such as a threat was made. For example I was threaten that if I did not pay the amount of money NCO requested, a lean will be put on my property.
- I filed a complaint to be reimburse for all the phone calls
that NCO made to me after I wrote them the letter . I have attached my own small_claims_complaint_as_an example. It is very easy to do, and there is free legal advise at the court house.
- A copy of the letter and the log of all the collection calls
NCO made to me after I wrote them the letter must be provided to the court.
- NCO attorney contacted me prior to the trial, and offer
me a settlement out of court, such as closing the account. I ask to be compensated for the collection efforts after I wrote them the letter .
- Please, be careful, the collector may falsify their records
to show they closed the account as soon as they got your letter this is why I need to bring with me to the court house the log of the phone calls to show that the collector did not close the collecting accounts, AND CONTINUED CALLING ME. I wrote down a summary of all the conversation with the NCO attorney.
